  1. General Provisions

    1. The online store available at www.bathroom-rea.co.uk is operated by Podlasiak UK Limited.
    2. These Terms and Conditions apply to consumers and business customers, subject to the limitations defined in Section 9.
    3. The Controller of personal data is the Seller; data processing rules are set out in the Privacy Policy available in the Store.
    4. Definitions: Business Day, Order Form, Customer, Account, Newsletter, Product, Terms and Conditions, Online Store, Seller, Sales Contract, Electronic Service, Service User, UK consumer legislation, Order.
    5. Consumer-equivalent business customer (UK: sole trader acting outside their business speciality): protections applicable to consumers under UK consumer law also apply to a sole trader where the nature of the contract indicates that it is not of a professional character for that person, in accordance with the Consumer Rights Act 2015.
  2. Electronic Services

    1. Account – created by completing the registration form and accepting these Terms and Conditions; provided free of charge for an indefinite period; the user may request deletion at any time by e-mail or in writing.
    2. Order Form – an interactive online form used to place an order; a one-off service which ends when the order is submitted or the process is abandoned.
    3. Newsletter – optional subscription; the Customer may unsubscribe at any time by contacting the Seller via e-mail.
    4. Technical requirements – a device with internet access, an active e-mail address, a current web browser, cookies and JavaScript enabled, minimum resolution 1024×768.
    5. Prohibited content – unlawful content must not be provided; the user is obliged to provide true and accurate data.
    6. Complaints regarding electronic services – may be submitted by e-mail to customer@bathroom-rea.co.uk; the Seller replies within 14 days.
  3. Conclusion of the Sales Contract

    1. A contract is concluded once the Customer places an order using the Order Form and the Store confirms its acceptance by e-mail.
    2. Prices are stated in GBP and include all applicable taxes. Delivery charges and any other costs are shown during checkout before the order is placed.
    3. The content of the contract is recorded by means of these Terms and Conditions and by providing the Customer with an e-mail confirmation.
    4. The final order button is labelled in a clear and legally compliant way, informing of the obligation to pay (for example: “Place order with obligation to pay”).
  4. Payments

    1. Available payment methods: PayPal and bank transfer to a UK bank account. Cash on delivery is not available in the United Kingdom.

    3. Payment deadline: for bank transfer/PayPal – within 7 days from the conclusion of the contract.
  5. Delivery and Collection

    1. Delivery is chargeable unless otherwise stated. Delivery rates are displayed on the Store website and at checkout.
    2. Delivery method: courier shipment via DPD (United Kingdom).
    3. Estimated delivery time: 7–10 Business Days, depending on location and courier operations.
    4. There is no guaranteed obligation of in-home carrying (upstairs delivery); if required, special arrangements may be requested before shipment and may involve additional fees.
  6. Complaints (goods not in conformity with the contract)

    1. The Seller is responsible for delivering goods in conformity with the contract in accordance with the Consumer Rights Act 2015.
    2. The provisions on complaints also apply to a consumer-equivalent business customer (sole trader acting outside their business speciality) insofar as UK law grants such protection.
    3. Complaints may be submitted by e-mail to customer@bathroom-rea.co.uk. The message should describe the lack of conformity and indicate the preferred remedy (repair or replacement). A price reduction or contract termination is possible only where statutory conditions are met.
    4. The Seller responds within 14 days. Lack of response within this period will be treated as acceptance of the complaint.
    5. Where return of the goods is required to assess the complaint, the Seller will provide return instructions and individual return address details depending on the logistics location handling the order.
  7. Alternative Dispute Resolution (ADR)

    1. Consumers in the UK have access to ADR schemes approved by the Chartered Trading Standards Institute (CTSI). Where direct resolution with the Seller is not possible, the Customer may request assistance from an approved ADR body (for example: RetailADR).
    2. Participation in ADR is voluntary. Further information is available at: https://www.tradingstandards.uk/consumers/support-advice.
  8. Right of Withdrawal

    1. Under the Consumer Contracts Regulations 2013, the Customer has 14 days to withdraw from a distance contract without giving any reason. The Seller grants a longer, more favourable period of 60 days from the day on which the goods are received.
    2. Withdrawal may be submitted by e-mail to customer@bathroom-rea.co.uk.
    3. The Seller refunds payments within 14 days of receiving the withdrawal notice; the Seller may withhold the refund until the goods are received or proof of return is provided.
    4. The return address is not fixed in advance; it is provided individually by the Seller depending on the logistics location handling the order.
    5. The Customer bears the direct cost of returning the goods.
    6. The Customer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
    7. Exclusions apply in accordance with the Consumer Contracts Regulations (for example: personalised goods, sealed goods not suitable for return due to health or hygiene reasons after opening, digital content supplied other than on a tangible medium after consent).
    8. The extended 60-day period also applies to a consumer-equivalent business customer (sole trader acting outside their business speciality) where UK law permits.
  9. Business Customers

    1. The Seller may limit available payment methods for business customers (e.g. bank transfer in advance).
    2. The risk of accidental loss or damage passes to the business customer upon handing the goods over to the carrier.
    3. The business customer is obliged to inspect the consignment and inform the carrier of any visible damage without undue delay.
    4. Liability for damages is limited to foreseeable losses up to the value of the order; loss of profit is excluded.
    5. These provisions do not apply where mandatory law affords consumer-level rights to a sole trader acting outside their business speciality.
  10. Privacy Policy

    1. Scope of data

      1. We process identification and contact details (e.g. name, address, e-mail, phone number), delivery and billing data, order history and payment information, technical data (IP address, device identifiers, cookies), as well as the content of correspondence.
      2. Providing data is voluntary but necessary for fulfilling the contract or specific services.
    2. Purposes and legal bases

      1. Order fulfilment and after-sales support – Art. 6(1)(b) UK GDPR.
      2. Account management, enquiries and complaints – Art. 6(1)(b) and (f) UK GDPR.

    3. Data recipients

      1. Courier and logistics providers (e.g. DPD), payment operators (PayPal), IT and hosting providers, accounting and customer-support providers – only to the extent necessary.
      2. We do not sell personal data to third parties.
    4. Transfers outside the UK

      1. As a rule, data is not transferred outside the UK. If exceptionally transferred, appropriate safeguards are applied (e.g. Standard Contractual Clauses or UK Addendum).
    5. Data retention

      1. Contract data – for the time necessary to perform the contract and legal obligations (including statutory retention periods).
      2. Marketing data – until consent is withdrawn or an objection is raised.
      3. Technical/cookie data – according to the lifecycle of cookies and browser settings.
    6. Rights of individuals

      1. Right of access, rectification, erasure, restriction, portability, and objection; right to withdraw consent (without affecting prior lawful processing).

    7. Cookies and similar technologies

      1. The Store uses necessary cookies, as well as functional, analytical and marketing cookies subject to browser settings and consent.

      1. We may apply basic profiling (e.g. segmentation for newsletter messages), which does not have legal or similarly significant effects.

  11. Final Provisions

    1. Contract language: English.
    2. The Seller may amend these Terms and Conditions for important reasons (changes in law, delivery methods, payment options); users will be notified 14 days before the change takes effect.
    3. Matters not regulated herein are governed by the law of England and Wales, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.
    4. The Store may send a voluntary post-purchase review request to improve service quality.
